Terms of Service
The agreement between you and Sonopeace, LLC governing your use of the Sonopeace Sleep Tracker app. These terms apply to the Sonopeace mobile app and connected services — not to purchases made on this store.
1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between you and Sonopeace, LLC ("Sonopeace", "we", "us"). By creating an account or using the Sonopeace Sleep Tracker app (the "App"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the App. By using the App you represent that you meet these requirements. The App is not directed to or intended for users under 16, and we do not knowingly collect data from anyone under that age.
3. The Sonopeace service
The App provides sleep tracking, sleep programs with audio playback, analytics and sleep-debt tracking, a manual sleep diary, smart alarms, wearable sync, AI-generated insights and a chat coach, achievements, and optional partner sharing. Features may change, be added, or be removed over time. The App is a wellness and informational tool.
4. Your account
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Medical disclaimer
The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Sleep scores, insights, and AI coaching are for informational and wellness purposes only and are not a substitute for professional medical advice. Always consult a qualified healthcare provider about any medical condition or before acting on information from the App. Never disregard professional medical advice because of something in the App. If you think you have a medical emergency, contact emergency services.
6. Subscriptions & payments
The App offers optional paid subscriptions ("Premium"). Subscriptions are sold and billed through the Apple App Store or Google Play and managed via our payments provider, RevenueCat. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current term. Manage or cancel subscriptions in your App Store or Google Play account settings. Payment, refund, and cancellation handling is subject to the applicable app store's terms; we do not directly process or store payment card details.
7. Acceptable use
You agree not to do any of the following:
- Reverse-engineer, decompile, or tamper with the App
- Use the App to violate any law or third party's rights
- Upload malicious code
- Attempt to gain unauthorized access to our systems or other users' data
- Use the App in any way that disrupts or harms the service
8. Intellectual property
The App, its content, software, design, and trademarks are owned by Sonopeace or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. You retain ownership of the sleep and diary data you provide.
9. Your data & privacy
Your use of the App involves the collection and processing of personal and health data as described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App you consent to those practices, including the anonymized research and data-retention provisions described there.
10. Third-party services
The App integrates optional third-party services, including wearable and health-platform providers (Oura, Fitbit / Google Health, Apple HealthKit, Android Health Connect), sign-in providers (Apple, Google), payment processors (Apple App Store, Google Play, RevenueCat), AI processing (OpenAI, for the AI insights and chat coach features), product analytics (PostHog, only when you have enabled analytics), and an authenticated ChatGPT app for read-only sleep analysis. Each integration is opt-in or can be disconnected from Settings. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and may change or discontinue integrations.
11. Disclaimers & warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that insights will be accurate or complete.
12. Limitation of liability
To the maximum extent permitted by law, Sonopeace and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the App. Our total aggregate liability for any claim relating to the App will not exceed the greater of the amount you paid Sonopeace in the 12 months before the claim or USD 100.
13. Indemnification
You agree to indemnify and hold Sonopeace harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any law or third-party right.
14. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated in-app or by email, and the effective date above will be revised. Continued use of the App after an update constitutes acceptance of the revised Terms.
16. Governing law & disputes
These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the App will be resolved exclusively in the state or federal courts located in Nevada, and you consent to the personal jurisdiction of those courts.
